E-Sign Consent

This E-Sign Consent explains how Bobby Built Ventures, LLC d/b/a SpendCaddie ("SpendCaddie," "we," "us," or "our") provides electronic records, disclosures, notices, communications, and signatures in connection with the SpendCaddie service.

By creating an account, accepting this E-Sign Consent, using the Service, starting a trial, purchasing a subscription, or continuing to use SpendCaddie after receiving electronic communications, you consent to receive records and communications electronically as described below.

1. Scope of electronic communications

Your consent applies to records and communications relating to SpendCaddie, including:

  • Terms of Service;
  • Privacy Policy;
  • Cookie Policy;
  • Subscription, Billing & Refund Terms;
  • Consent & Communication Preferences;
  • Mobile App EULA;
  • account notices;
  • legal notices;
  • privacy notices;
  • billing notices;
  • subscription notices;
  • trial notices;
  • cancellation or entitlement notices;
  • security notices;
  • support communications;
  • consent records;
  • policy updates;
  • receipts, confirmations, and transactional communications;
  • data-rights request communications; and
  • any other disclosures, records, or notices we are legally permitted to provide electronically.

SpendCaddie does not currently send SMS/text-message alerts, marketing texts, or SMS-based MFA. Electronic communications are primarily provided through the website, app, email, in-app notices, account settings, and provider flows such as Stripe or Apple.

2. Electronic signatures

You agree that your electronic actions may have the same legal effect as handwritten signatures where permitted by law. Examples include:

  • clicking "I agree" or similar buttons;
  • checking consent boxes;
  • submitting forms;
  • creating an account;
  • starting a trial;
  • purchasing a subscription;
  • accepting updated terms;
  • connecting financial accounts through Plaid;
  • submitting privacy requests; and
  • confirming account deletion or other account actions.

3. Hardware and software requirements

To access and retain electronic communications, you need:

  • a device with internet access;
  • a current web browser or supported mobile app;
  • the ability to access SpendCaddie online;
  • an active email account;
  • software capable of opening common file formats such as HTML, PDF, JSON, CSV, or text files where provided;
  • enough device or cloud storage to save records; and
  • a printer or other method to print records if you want paper copies.

By consenting, you confirm that you can access electronic records using your current device and software.

4. Paper copies

You may request a paper copy of certain records by contacting support@spendcaddie.com. We may ask you to verify your identity and mailing address. We may not be able to provide paper copies of every record, especially records controlled by third-party providers such as Apple, Stripe, Plaid, or your financial institution.

Where permitted by law, we may charge a reasonable fee for paper copies or shipping. We will tell you about any fee before providing the paper copy.

You may withdraw your consent to electronic communications by contacting support@spendcaddie.com. Withdrawing consent may prevent us from providing the Service because SpendCaddie is an online and mobile-first service that requires electronic delivery of terms, notices, billing communications, privacy notices, account information, and security communications.

If you withdraw consent, we may close your account, restrict access, or require you to stop using the Service. Withdrawal does not affect the validity of electronic communications or signatures provided before withdrawal.

Withdrawing E-Sign consent does not automatically cancel any active subscription. You must cancel web subscriptions through the SpendCaddie billing portal or Stripe-supported flow, and iOS subscriptions through Apple subscription settings.

6. Updating contact information

You are responsible for keeping your email address and account contact information current. If your email address changes, update it in account settings or contact support@spendcaddie.com.

If you do not keep your contact information current, you may miss important account, billing, security, policy, or legal communications.

SpendCaddie may store records of your electronic consents, including policy version, timestamp, IP address, user agent, consent text, and related audit metadata where available. These records may be retained as described in our Privacy Policy and Data Retention Notice.
