DMCA Policy

Bobby Built Ventures, LLC d/b/a SpendCaddie respects intellectual property rights. This DMCA Policy explains how to submit copyright takedown notices and counter-notices under the Digital Millennium Copyright Act.

SpendCaddie is primarily a consumer debt planning and debt coaching service and does not currently operate as a public user-generated content publishing platform. However, users may submit notes, support messages, profile content, feedback, or other content through the Service.

If you believe content on SpendCaddie infringes your copyright, your notice should include:

  1. your physical or electronic signature;
  2. identification of the copyrighted work claimed to have been infringed;
  3. identification of the material claimed to be infringing and information reasonably sufficient to permit us to locate it;
  4. your contact information, including name, address, telephone number, and email address;
  5. a statement that you have a good-faith belief that use of the material is not authorized by the copyright owner, its agent, or the law; and
  6. a statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on behalf of the copyright owner.

Incomplete notices may not be processed.

3. Counter-notices

If you believe content was removed or disabled by mistake or misidentification, you may submit a counter-notice containing:

  1. your physical or electronic signature;
  2. identification of the material removed or disabled and where it appeared before removal;
  3. a statement under penalty of perjury that you have a good-faith belief the material was removed or disabled by mistake or misidentification;
  4. your name, address, telephone number, and email address;
  5. a statement that you consent to jurisdiction of the federal district court for your judicial district, or if outside the United States, the District of Colorado; and
  6. a statement that you will accept service of process from the person who provided the original notice or that person's agent.

4. Repeat infringers

SpendCaddie may terminate or restrict accounts of users who repeatedly infringe copyrights or repeatedly submit infringing content, where appropriate.

5. Misrepresentations

Knowingly submitting false copyright notices or counter-notices may result in liability under the DMCA or other laws. You should consult an attorney if you are unsure whether material is infringing.
