Mobile App End User License Agreement

This Mobile App End User License Agreement ("Mobile EULA") applies to the SpendCaddie mobile application (the "App"). It supplements the Terms of Service. If this Mobile EULA conflicts with the Terms of Service, the Terms control for account, commercial, arbitration, billing, and liability issues unless this Mobile EULA expressly states otherwise.

This Mobile EULA is between you and Bobby Built Ventures, LLC d/b/a SpendCaddie ("SpendCaddie," "we," "us," or "our"), not Apple or Google. Apple and Apple's subsidiaries are third-party beneficiaries of this Mobile EULA as described below. Google is not a party to this Mobile EULA and has no obligation to provide maintenance or support for the App.

1. License

Subject to your compliance with this Mobile EULA and the Terms of Service, SpendCaddie grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the App on compatible iOS or Android devices that you own or control, as permitted by the applicable Apple App Store or Google Play terms and usage rules.

The App is licensed, not sold. SpendCaddie and its licensors retain all rights not expressly granted.

2. Eligibility

You may use the App only if you are at least 18 years old, are a resident of the United States, and agree to the Terms of Service, Privacy Policy, E-Sign Consent, and other applicable policies.

3. Restrictions

You may not:

  • copy, modify, distribute, sell, lease, sublicense, or transfer the App;
  • reverse engineer, decompile, disassemble, or attempt to derive source code except where permitted by law;
  • bypass security, billing, entitlement, plan, or access controls;
  • use the App on behalf of an unauthorized person;
  • connect financial accounts you are not authorized to use;
  • use the App for unlawful, fraudulent, credit repair, debt settlement, lending, money transmission, or third-party advisory purposes; or
  • use the App in violation of the Acceptable Use Policy.

4. App store platform terms

Your use of the App must comply with Apple Media Services Terms and Conditions and any other applicable Apple terms.

You and SpendCaddie acknowledge that:

  • this Mobile EULA is between you and SpendCaddie, not Apple;
  • SpendCaddie, not Apple, is solely responsible for the App and its content;
  • Apple has no obligation to provide maintenance or support for the App;
  • SpendCaddie, not Apple, is responsible for addressing claims relating to the App or your possession and use of the App, including product liability, legal/regulatory, consumer protection, privacy, and similar claims, to the extent not disclaimed or limited under applicable law;
  • SpendCaddie, not Apple, is responsible for investigating, defending, settling, and discharging third-party intellectual property infringement claims relating to the App or your possession and use of the App;
  • in the event of any failure of the App to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price for the App, if any, as required by Apple's terms; and
  • to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.

You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a terrorist-supporting country and that you are not listed on any U.S. Government list of prohibited or restricted parties.

Apple and Apple's subsidiaries are third-party beneficiaries of this Mobile EULA and may enforce it against you as a third-party beneficiary.

If you obtain the App through Google Play, your use must also comply with the Google Play Terms of Service and applicable Google Play policies. SpendCaddie, not Google, is responsible for the App, its content, maintenance and support, and claims relating to the App to the extent required by law. Google controls Google Play distribution and platform services under its own terms.

5. Mobile subscriptions and RevenueCat

If you purchase a subscription through the App, Apple processes iOS billing through Apple In-App Purchase and Google processes Android billing through Google Play Billing. SpendCaddie uses RevenueCat to manage entitlement, purchase history, and subscription status.

Apple controls iOS subscription billing, renewal, cancellation, refund, trial, and introductory offer handling according to Apple's terms. You must cancel iOS subscriptions through Apple subscription settings.

Google controls Android subscription billing, renewal, cancellation, refund, trial, and introductory offer handling according to Google Play's terms. You must cancel Android subscriptions through Google Play subscription settings.

Deleting your SpendCaddie account does not automatically cancel an Apple or Google Play subscription. If you delete your account without canceling your mobile subscription, the applicable store may continue billing until you cancel through its subscription settings.

6. Device permissions and app data

The App may request or use device permissions and local storage to provide features, including:

  • photo library access for profile images or user-selected uploads;
  • push notification permissions for account alerts and service messages;
  • biometric authentication, Face ID, Android device authentication, or PIN unlock where available;
  • SecureStore or similar secure storage for certain authentication or PIN-related data;
  • local app storage or cache for app state, account information, debt information, financial data, preferences, and performance; and
  • device and app metadata for security, troubleshooting, entitlement, and support purposes.

Not every local app cache is necessarily encrypted by SpendCaddie. You should protect your device using device-level security features such as passcode, biometric lock, operating system updates, and device encryption where available.

7. Financial data and Plaid

If you connect financial accounts through the App, SpendCaddie uses Plaid to connect accounts on a read-only basis. SpendCaddie does not receive or store your bank login credentials. Plaid access tokens are stored encrypted on SpendCaddie's backend, not as raw tokens in the App.

Financial data may be displayed in the App and may be cached locally for app functionality. You are responsible for securing your device.

8. AI features

The App may provide AI explanations of deterministic SpendCaddie plan outputs. AI does not calculate canonical balances, interest, payoff order, payment amounts, payoff dates, or strategy. AI outputs are informational and may be inaccurate or incomplete.

9. Updates

We may update the App from time to time. Updates may add, modify, or remove features. You may need to install updates to continue using the App. We do not guarantee that every feature will be available on every device, iOS version, or Android version.

10. Support

Support for the App is provided by SpendCaddie on a best-effort basis as described in the Support Policy. Apple and Google have no obligation to provide maintenance or support for the App.

11. Termination

This Mobile EULA is effective until terminated. Your rights under this Mobile EULA terminate automatically if you violate it or the Terms. Upon termination, you must stop using and delete the App. Termination does not cancel active subscriptions.

12. Warranty disclaimer and limitation of liability

The App is provided "as is" and "as available" to the maximum extent permitted by law. The warranty disclaimers and limitation of liability in the Terms of Service apply to the App.

13. App availability

SpendCaddie is available through the Apple App Store and Google Play in supported U.S. storefronts. Platform availability, compatible devices, billing features, and release timing may differ between stores.
