Mobile App End User License Agreement

1. Agreement to Terms
This End User License Agreement (“EULA”) is a legal agreement between you and SpendCaddie for the use of our mobile application (“App”). By downloading, installing, or using the App, you agree to be bound by this EULA.
2. License Grant
Subject to your compliance with this EULA, SpendCaddie grants you a limited, non-exclusive, non-transferable, revocable license to:
- Download and install the App on devices you own or control
- Use the App for personal, non-commercial purposes
- Access the services provided through the App
3. License Restrictions
You may NOT:
- Copy, modify, or distribute the App
- Reverse engineer, decompile, or disassemble the App
- Rent, lease, or lend the App to third parties
- Use the App for any unlawful purpose
- Remove or alter any proprietary notices
- Use the App to build a competing product
4. Ownership
The App is licensed, not sold. SpendCaddie and its licensors retain all rights, title, and interest in and to the App, including all intellectual property rights. This EULA does not grant you any rights to trademarks or service marks.
5. Third-Party Services
The App may integrate with third-party services such as:
- Plaid for financial data aggregation
- Apple Pay / Google Pay for payments
- Push notification services
Use of these services is subject to their respective terms and privacy policies.
6. App Store Terms
6.1 Apple App Store
If you downloaded the App from the Apple App Store, you acknowledge that:
- This EULA is between you and SpendCaddie, not Apple
- Apple has no obligation to provide support or maintenance
- Apple is not responsible for addressing claims relating to the App
- Apple and its subsidiaries are third-party beneficiaries of this EULA
6.2 Google Play Store
If you downloaded the App from Google Play, you acknowledge that Google has no obligation under this EULA and you agree to Google Play's Terms of Service.
7. Privacy and Data
Your use of the App is subject to our Privacy Policy, which describes how we collect, use, and protect your personal information. The App may:
- Access your device's camera (for check deposits, if applicable)
- Request notification permissions
- Use biometric authentication
- Store data locally on your device
8. Updates
We may release updates to the App from time to time. Some updates may be required for continued use. We recommend enabling automatic updates to ensure you have the latest security patches and features.

For technical support with the App, please contact us at support@spendcaddie.com or through the in-app help center. Support is provided in English during business hours.
10. Disclaimer of Warranties
THE APP IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND. SPENDCADDIE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SPENDCADDIE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP.
12. Termination
This EULA is effective until terminated. Your rights under this EULA will terminate automatically if you fail to comply with any terms. Upon termination, you must uninstall and delete all copies of the App.
13. Export Compliance
You agree to comply with all applicable export and import laws. You may not download or use the App if you are located in a country subject to U.S. embargo or are on a prohibited party list.
14. Governing Law
This EULA is governed by the laws of the State of Colorado, without regard to conflict of law principles. Any disputes arising under this EULA shall be subject to the arbitration provisions set forth in our Terms of Service, which you agreed to when creating your SpendCaddie account.
15. Dispute Resolution
All disputes are subject to binding arbitration under the AAA Consumer Arbitration Rules, with limited exceptions for small claims (under $10,000). You may opt out of arbitration within 30 days of creating your account by emailing legal@spendcaddie.com with the subject line "Arbitration Opt-Out." See our Terms of Service for complete details.
